1. Acceptance of terms
By accessing this website, joining the waitlist, or using the ClipStream Telegram bot (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a legally binding agreement between you and ClipStream. Please read them carefully.
2. Description of service
ClipStream is a content automation tool that enables users to:
- Download publicly available video content from YouTube and other platforms via URL
- Automatically generate short-form clips with AI-assisted scene detection
- Add captions, overlays, and other visual enhancements to clips
- Schedule and publish clips to social media platforms including TikTok, Instagram, and YouTube Shorts
- Track basic analytics related to published content
The Service operates via a Telegram bot interface and supporting infrastructure. ClipStream is currently in alpha/beta. Features may change, break, or be removed without notice.
3. Eligibility
You must be at least 13 years of age (or 16 in the EEA) to use ClipStream. By using the Service, you represent that you meet this requirement.
You must also comply with the terms of service of any third-party platform you post to through ClipStream (TikTok, Instagram, YouTube, etc.).
4. Accounts and access
Access to ClipStream is granted via an invite code. You are responsible for keeping your invite code confidential. Sharing your invite code with others may result in your access being revoked.
We reserve the right to revoke access at any time, for any reason, with or without notice.
During the alpha/beta phase, access is free and provided on an as-is basis. We make no guarantee of continued availability.
5. Your content and licences
Content you submit
You retain all ownership rights to content you upload directly to ClipStream (e.g., video files you send to the bot). By using the Service, you grant ClipStream a limited, non-exclusive licence to process, transform, and store that content solely for the purpose of delivering the Service to you.
Content rights — your responsibility
Important: ClipStream is a tool for processing and publishing content you own or have explicit rights to. You are solely responsible for ensuring you have full legal authority to process, clip, and publish any content you submit. ClipStream does not verify ownership or licensing of any content.
By submitting any content (via file upload, URL, or otherwise), you represent and warrant that:
- You are the original creator of the content, or you hold a valid licence or explicit permission from the rights holder to use it in the manner you intend
- You have the right to publish that content on TikTok, Instagram, YouTube, and any other destination platform you select
- Your use complies with the Terms of Service and Community Guidelines of any source and destination platform
- Your use complies with all applicable copyright laws, including any fair use provisions in your jurisdiction
- You will not use ClipStream to infringe, circumvent, or facilitate the infringement of any third party's intellectual property rights
ClipStream is designed for creators publishing their own content — including original videos, licensed footage, and content created under explicit permission agreements. Use of the Service to publish content you do not have rights to is a violation of these Terms and may result in immediate account termination.
DMCA / Copyright
ClipStream respects intellectual property rights. If you believe content posted through our Service infringes your copyright, please contact us at gymaneie763@gmail.com with the subject line "DMCA Notice" and include:
- Identification of the copyrighted work you believe has been infringed
- Identification of the infringing material and its location
- Your contact information
- A statement that you have a good faith belief the use is not authorised
- A statement that the information in your notice is accurate, under penalty of perjury
6. Acceptable use
You agree not to use ClipStream to:
- Infringe, misappropriate, or violate any intellectual property rights
- Post spam, coordinated inauthentic behaviour, or misleading content
- Harass, threaten, or harm any individual or group
- Violate any applicable law or regulation
- Circumvent or attempt to circumvent access controls, rate limits, or bot detection systems on third-party platforms
- Use the Service to post content that violates TikTok, Instagram, or YouTube's community guidelines (including violent, sexual, hateful, or dangerous content)
- Attempt to reverse-engineer, decompile, or extract the source code of ClipStream
- Resell or redistribute access to ClipStream without prior written permission
Violation of these terms may result in immediate termination of access and, where applicable, referral to appropriate authorities.
7. Intellectual property
All intellectual property in the ClipStream software, interface, and branding — including the name, logo, and design — belongs to ClipStream. Nothing in these Terms transfers any IP rights to you.
You may not use the ClipStream name, logo, or brand in any way without prior written consent.
8. Third-party platforms
ClipStream integrates with third-party platforms including Telegram, TikTok, Instagram, YouTube, and Upload-Post.com. Your use of those platforms is governed by their own terms and privacy policies.
ClipStream is not affiliated with, endorsed by, or sponsored by TikTok, Meta, Google, Telegram, or any other third-party platform. We are an independent automation tool.
Third-party platform APIs may change or become unavailable at any time. ClipStream accepts no liability for service interruptions caused by changes to third-party APIs or platforms.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Videos will be processed, uploaded, or published successfully at all times
- Content processed through the Service will not be subject to removal by destination platforms
- Analytics data will be accurate or complete
During the alpha/beta phase, the Service is experimental. Expect bugs, downtime, and breaking changes.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIPSTREAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve months preceding the claim (which, during the free alpha, is zero).
Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability is limited to the greatest extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless ClipStream and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your infringement of any third-party intellectual property rights
- Content you process or publish through the Service
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause or notice. Reasons may include but are not limited to violation of these Terms, abuse of the platform, or platform shutdown.
You may stop using the Service at any time. To request deletion of your account and data, contact us at gymaneie763@gmail.com.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 5, 9, 10, 11, and 13) will continue to apply.
13. Governing law and disputes
These Terms are governed by and construed in accordance with the laws of the United States and the laws of the State of Florida, without regard to its conflict of law provisions.
Informal resolution
Before filing any formal legal claim, you agree to contact us at gymaneie763@gmail.com and attempt to resolve the dispute informally. We will make a good-faith effort to resolve the matter within 30 days.
Binding arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in English. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
You and ClipStream both waive the right to a jury trial and the right to participate in a class action lawsuit or class-wide arbitration.
Exceptions
Either party may seek emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm while arbitration is pending. Claims involving intellectual property infringement may also be brought in court.
Venue
To the extent any dispute proceeds in court rather than arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Florida, United States, and waive any objection to such venue.
14. Changes to these terms
We may update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and, where practical, notify active users via Telegram.
Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
